Release of Liability, Assumption of Risk & Indemnity Agreement

1. The activity

I am voluntarily taking part in a guided fishing trip provided by Chilly's Guide Service and Jacob Childers on the Lower Columbia River and connected waters, including travel by boat, launching and landing, fishing, and handling fish and gear ("the Activity").

2. I understand the risks

I understand that boating and fishing on a large, cold, fast-moving river carry real risks that cannot be eliminated no matter how careful the Guide is. Those risks include, but are not limited to:

• Drowning, hypothermia, and cold-water immersion from falling overboard, capsizing, or swamping.
• Collision, grounding, or contact with other vessels, logs and debris, shallow water, pilings, buoys, or dam and lock structures.
• Strong current, wind, waves, wakes, fog, tide changes, and sudden changes in weather and river conditions.
• Slips, trips, and falls on wet, uneven, or moving surfaces, on docks and ramps, and while boarding or leaving the boat.
• Injury from hooks, lines, weights, knives, gaffs, nets, rods, and other fishing gear, including gear handled by other anglers.
• Injury from fish, including bites, spines, teeth, and the weight and movement of large salmon and sturgeon.
• Sunburn, dehydration, heat exhaustion, seasickness, and exposure.
• Remote locations where medical help may be far away and emergency response may be delayed.
• The actions of other guests on the boat, and of other boaters and river users.
• Mechanical or equipment failure.
• The Guide's or my own errors in judgment, including negligence.

3. I accept those risks

Knowing these risks, I choose to take part in the Activity anyway. I assume full responsibility for all risks of injury, illness, death, and property damage or loss arising from the Activity, whether those risks are listed above or not, and whether they are known or unknown to me.

4. I am fit to participate

I confirm that I am in good enough health to take part safely, that I am not under the influence of alcohol or drugs that would impair my judgment or balance, and that I have told the Guide about any medical condition, medication, mobility limitation, or inability to swim that could affect my safety. I will wear a life jacket whenever required and whenever the Guide directs, and I will follow the Guide's safety instructions at all times.

5. Release and waiver of claims

To the fullest extent permitted by Washington law, I release, waive, and discharge Jacob Childers, Chilly's Guide Service, and their owners, employees, contractors, agents, and insurers (together, "the Released Parties") from any and all claims, demands, and causes of action of any kind for injury, illness, death, or damage to or loss of property that arise out of or relate to my participation in the Activity, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES.

This release does not apply to injury or damage caused by the gross negligence or intentional misconduct of a Released Party, and does not waive any right that cannot be waived under Washington law.

I agree not to sue any Released Party for a claim covered by this release, and I agree that this release applies to me and to my spouse, family, heirs, estate, and anyone else who might bring a claim on my behalf.

6. Indemnity

I agree to indemnify and hold harmless the Released Parties from any claim, loss, or expense, including reasonable attorneys' fees, that a Released Party incurs because of my conduct during the Activity, or because of a claim brought by me or on my behalf that is covered by this release.

7. Medical treatment

If I am injured or become ill and cannot speak for myself, I authorize the Guide to obtain emergency medical care for me. I am responsible for the cost of any medical care, transportation, and evacuation.

8. Participants under 18

If I am accepting this Release on behalf of a participant under 18, I confirm that I am the minor's parent or legal guardian, that I have read this Release and understand it, that I consent to the minor's participation, and that I make every promise in this Release on the minor's behalf and on my own behalf. I agree to supervise the minor throughout the trip.

9. Photos

I allow Chilly's Guide Service to use photos and video of me taken during the Activity on its website and social media, without payment. I can withdraw this consent by telling the Guide before or during the trip.

10. Governing law and severability

This Release is governed by the laws of the State of Washington. Any dispute will be brought in the state or federal courts serving Cowlitz County, Washington. If any part of this Release is found unenforceable, that part will be limited to the minimum extent necessary and the rest will remain in full effect.

11. Acknowledgement

I HAVE READ THIS RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNITY AGREEMENT. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE. I AM ACCEPTING IT VOLUNTARILY, WITHOUT ANY PRESSURE, AND I INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE TO THE FULLEST EXTENT PERMITTED BY LAW.

Checking the acceptance box at online checkout is my electronic signature under the federal E-SIGN Act and Washington's Uniform Electronic Transactions Act. When this Release is signed on paper, my signature below has the same effect. This version is dated 2026-09-03.
